U.S. Attorney Preet Bharara this morning essentially cleared Sen. David Carlucci in the widespread bribery scheme to give Sen. Malcolm Smith a shot at the New York City Republican mayoral primary.

To recap, the criminal complaint released today referenced a “Spring Valley State Senator” who Smith had advised an undercover FBI agent posing as a wealthy developer to turn to when seeking $500,000 in state funds for a road project.

The construction would greatly enhance the value of a real estate project and Smith had sought in return bribes to New York City Republican officials in order to obtain a Wilson Pakula.

Though not named in the complaint, the lawmaker is most likely Sen. David Carlucci, a fellow member of the Independent Democratic Conference who represents Spring Valley.

Asked about Carlucci’s role, Bharara today said “there’s no evidence of any misdeeds at all” by the lawmaker.
